অতিমারী করোনা, ভারত সহ সমগ্র বিশ্ব করোনার মারে জর্জরিত। বারবার অভিযোগ উঠেছে যে, সেই ভয়াল পরিস্থিতিতে পশ্চিমবঙ্গ সরকার লুকিয়েছেন আক্রান্তের তথ্য, বদলে দিয়েছেন অতিমারীতে মৃতের সংখ্যা তথ্য। রাজ্যে বারবার টান পড়েছে PPE কিটে জানিয়েছেন ডাক্তার বাবুরা, রোগীরা অভিযোগ করেছেন নিম্নমানের খাদ্য নিয়ে, হাসপাতালের পর হাসপাতাল – ডাক্তার থেকে নার্স, স্বাস্থ্য কর্মীরা শিকার হয়েছেন অতিমারীর। কিন্তু তারপর তাঁদের কি হল ? সে বিষয়ে জানা যায় না…..
উক্ত বিষয়গুলিকে কেন্দ্র করে মাননীয় সুপ্রিম কোর্টের ব্যারিস্টার শ্ৰী কবীর শঙ্কর বোস ব্যক্তিগত উদ্যোগে কলকাতা হাইকোর্টে দায়ের করেন একটি জনস্বার্থ মামলা। সেই ভিত্তিতে কেন্দ্রের স্বরাষ্ট্রমন্ত্রক (MHA) একটি টিম পশ্চিমবঙ্গে পাঠাতে আগ্রহ প্রকাশ করেন । অপর দিকে পশ্চিমবঙ্গের রাজ্য সরকার তার বিরোধীতা করেন। সেই ভিত্তিতে কোর্ট জানিয়েছেন , যে সাত দিনের ভিতরে কেন্দ্র সরকার এবং রাজ্য সরকার কোভিড পরিস্থিতির উপর রিপোর্ট প্রদান করুন এবং যদি কেন্দ্রীয় MHA টিম পশ্চিমবঙ্গে আসতে চান – কোভিভ পরিস্থিতি দেখার উদ্দেশ্যে , তবে তাঁরা আসতে পারেন। এবিষয় কোর্ট অর্ডারটি নীচে লেখার সঙ্গে সংযুক্ত করা হল।
এখন প্রশ্ন হল পূর্বে যে কেন্দ্রীয় দল এসেছিলেন এবং এখন যাঁরা আসছেন তাঁদের কাজের ভিত্তিতে কি পার্থক্য আছে?
উত্তরে শ্ৰী কবীর শঙ্কর বোস জানান, অর্ডারের ভিত্তিতে আগে একটি ICMT টিম এসেছিল। ICMT অর্থাৎ, ইনটার মিনিস্ট্রিয়াল টিম। কিন্তু MHA হল এই ধরনের বিষয়ে দেখভাল করার জন্য একটি অধিকতর গুরুত্বপূর্ণ মিনিস্ট্রি। এছাড়াও এটি ডিজাস্টার ম্যানেজমেন্ট এক্টের মধ্যে পড়ে। তাই MHA হল একটি এক্সক্লুসিভ টিম পাঠাতেই পারে।
বার বার জনগণের মধ্যে রেশনিং ব্যবস্থা বন্টন নিয়ে নানা অভিযোগ সামনে আসছে রাজ্য সরকারের বিরুদ্ধে, রাজ্যপাল এবিষয়ে একাধিকবার উল্লেখ করেছেন। সেই নিয়ে কোর্টের ব্যক্তব্য কি ? এই টিম এলে জনগনের কি সুবিধা হবে ?
উত্তরে শ্ৰী কবীর শঙ্কর বোস বলেন , MHA যেহেতু ডিজাস্টার ম্যানেজমেন্ট এক্টের বিষয়ে অধিকতর গুরুত্ব দেয়, তাই যদি কেন্দ্রীয় সরকার কোনো টিম পাঠান তাহলে অনুমান যে, তাঁরা পিটিশনে উল্লিখিত ইস্যুর ভিত্তিতে কোর্টকে রিপোর্ট দিতে পারবেন।
তিনি বলেন , যে কোভিড অতিমারীর চেহারার নেওয়া ইস্তক হোম মিনিস্ট্রির কোনো টিম বাংলায় আসেননি।তাই এই যে কোর্টের নির্দেশের ভিত্তিতে হোম মিনিস্ট্রির টিম বাংলায় আসছেন , তা বাংলার জনগণের কাছে অক্সিজেনের মত কাজ করবে। তাঁরা সব পর্যবেক্ষণ করে হাইকোর্টেকে রিপোর্ট দিতে পারবেন, যে বাংলায় কী পরিস্থিতি। সেই রিপোর্ট পেশ হলে কোর্ট সব বিষয়ে অবগত হবেন। রিপোর্ট-এর কপি রাজ্য ও কেন্দ্র তথা কোর্ট সকলেই পাবেন। তখন করণা মোকাবেলায় সঠিক পদক্ষেপ করা আরও সহজ হবে।
কোর্টে পিটিশনের ইস্যুগুলির ভিত্তিতে জবাব দেবার জন্য কেন্দ্র একটি দল পশ্চিমবঙ্গে পাঠাতে চান।
এখন দেখা যাক কোর্টের নির্দেশের ভিত্তিতে ফলাফল কি হয় ?

The world, including India, is plagued by Corona Pandemic. Amidst this horrific situation it is being repeatedly alleged that the West Bengal government is hiding the count of the affected and the dead. According to the doctors there is an acute PPE kit shortage, while patients are complaining of poor quality food. Hospitals are succumbing – doctors, nurses, health workers – to the pandemic. But there is no further news on their status…
Based on this data, Hon’ble Supreme Court Barrister Shri Kabir Shankar Bose filed a public interest litigation in the Calcutta High Court on his own initiative. On that basis, the Ministry of Home Affairs (MHA) expressed interest in sending a team to West Bengal. The state government of West Bengal is opposing this move. The court directed that the central and the state governments place the report on the Covid situation within seven days, and if the central MHA team wants to visit West Bengal to assess the Covid situation, they can come. The court order in this regard is attached below.
Now the question is what is the difference between the work of the central team that came before and those who are coming now?
In reply, Shri Kabir Shankar Bose said that an ICMT or an Inter-Ministerial team had come earlier. Now MHA can send an exclusive team as it is this ministry that takes care of such matters and also falls under the Disaster Management Act.
The Governor has repeatedly mentioned that various allegations pour in against the state government regarding the distribution of rationing. What is the opinion of the court on this? What will be the benefit of the people when this team comes?
In reply, Mr. Kabir Shankar Bose said, that since the MHA attaches more importance to the Disaster Management Act, if the Central Government sends a team, it is assumed that they will be able to report to the court on the issues mentioned in the petition.
He added that no team from the Home Ministry has come to Bengal after the Covid pandemic. Therefore, based on the order of the court, the team from Home Ministry arriving in Bengal will be like oxygen to the people of Bengal. They will be reporting to the High Court on the situation in Bengal after due observations. Once the report is submitted, the court will be aware of the situation and the copies of the report will be available to both the center and the state as well. The report will make it easier to take the right steps in dealing with Corona pandemic.
The Center wants to send a team to West Bengal based on this petition so let’s wait for the outcome of this endeavour.
